Terms and conditions

This End User License Agreement (“EULA”) is a legal agreement between you (“User” or “you”) and Dataminds Consulting LLC, doing business as DIY MAX (“Company,” “we,” “our,” or “us”). By downloading, installing, or using the DIY MAX software and services (“Software”), you agree to be bound by the terms of this EULA.

1. License Grant

Dataminds Consulting LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Software solely for your personal, non-commercial use, subject to the terms and conditions of this EULA.

2. Ownership

The Software and all associated intellectual property rights are owned by Dataminds Consulting LLC or its licensors. This EULA does not transfer any ownership rights in the Software to you.

3. Restrictions

You may not:
  • Modify, distribute, or create derivative works of the Software.
  • Reverse engineer, decompile, or disassemble the Software, except as expressly permitted by applicable law.
  • Use the Software for any unlawful purpose or in violation of this EULA.

4. Updates and Changes

Dataminds Consulting LLC may provide updates, upgrades, or modifications to the Software. Any such updates are governed by this EULA unless accompanied by a separate license agreement. Dataminds Consulting LLC reserves the right to change or remove features of the Software at any time.

5. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Dataminds Consulting LLC if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Software and delete all copies.

6. Disclaimer of Warranties

The Software is provided “as is” without any warranties of any kind, express or implied. Dataminds Consulting LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, Dataminds Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Software.

8. Governing Law and Dispute Resolution

This EULA shall be governed by and construed in accordance with the laws of Florida, United States. Any disputes arising under or in connection with this EULA shall be resolved through binding arbitration in Colorado, except that either party may seek injunctive or equitable relief in the courts of Colorado.

9. User-Generated Content

If the Software allows you to generate content, you retain ownership of any intellectual property rights that you hold in that content. By submitting content, you grant Dataminds Consulting LLC a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, publish, and translate that content.

10. Privacy and Data Collection
